Alcohol Policy

Purpose: To describe the conditions under which alcoholic liquor may be served and sold on campus.

Applies to: All faculty, staff, students and campus visitors of Pittsburg State University.

Policy:

I. Service of Alcoholic Beverages

Service of alcoholic beverages is not permitted on university property except in accordance with this policy. Service of alcoholic beverages is subject to the following requirements: 

1. At all times, the serving of alcohol on the PSU campus must be in compliance with the Kansas Liquor Control Act and the Kansas Club and Drinking Establishment Act.
2. Alcohol may only be served in connection with official university events, fundraising activities for university programs, or other events that further the university’s mission.
3. Such events cannot be open to the general public and only members of the sponsoring organizations, their spouses or significant others, and invited guests may be served alcohol.
   1. The person, persons, organization, or organizations hosting the event shall have an invitation list of those invited to attend the event. Only invitees shall be permitted to attend the event.
   2. Approximately 75% of the guests in attendance shall be 21 years of age or older or accompanied by their legal guardian.
4. Alcohol may not be served in connection with events held by student organizations.
5. All events on the university campus in which alcohol will be served must be pre-approved by the President. Event organizers wishing to serve alcohol on campus must submit a detailed plan to the President for review prior to any public announcement, but in no case less than two weeks before the event. This detailed plan must include the number of guests that will be in attendance, the designated area in which alcohol will be served, and the control measures that will be in place to ensure this alcohol policy and the laws of the State of Kansas are not violated.
6. The university food service vendor shall be the exclusive caterer for the service of alcohol on campus. The university food service vendor shall provide all personnel necessary for and have full control over dispensing alcohol at approved events. The university food service vendor will adhere to the following in its capacity as caterer:
   1. The university food service vendor shall be responsible for the event's compliance with federal, state, and local laws and ordinances related to the consumption of alcohol;
   2. Non-alcoholic beverages (in addition to water) shall be available to invitees during the entire event; and
   3. The university food service vendor shall serve food at the event.
7. Service of alcoholic beverages is permitted only in the following non-classroom settings:
   • Jack H. Overman Student Center
   • First floor lobby of Porter Hall
   • First floor lobby of McCray Hall
   • Reception area of McPherson Hall
   • Rotunda of the Kansas Technology Center
   • Lawn of Kansas Technology Center adjacent to Brooker Sundial
   • Carnie Smith Stadium Skyboxes
   • Crossland House
   • Bicknell Family Center for the Arts
   • Plaster Center
   • Champions Club of the Weede Physical Education Building
   • Other locations as approved by the President
     
8. The President may make exceptions to this policy at his or her discretion, provided the exception is in accordance with applicable state law.

 II.  Sales of Alcoholic Beverages at Intercollegiate Athletic Competitions 

A. Sales of alcoholic beverages at intercollegiate athletic competitions are only permitted in accordance with the following policy:

1. Sales of alcoholic beverages shall be conducted solely by the university food service vendor.
2. All sales and consumption of alcoholic beverages shall be lawful.
3. Non-alcoholic beverages and food shall be available when alcoholic beverages are sold.
4. In order to purchase alcoholic beverages, customers must have valid state identification with photograph and date of birth. Individuals who have reached the minimum age required to purchase an alcoholic beverage will have a wristband affixed by a member of the sales staff.  Customers are be required to show identification each time they request to purchase an alcoholic beverage.
5. Customers may purchase only one alcoholic beverage at a time.
6. Persons attending intercollegiate athletic events are not permitted to bring in alcoholic beverages. Only the university food service vendor is permitted to bring alcoholic beverages into any athletic facility, with the exception of the Skyboxes, as provided in III. A. 2. of this policy.
7. Sales of alcoholic beverages must end before the completion of the competition. For football games, sales must end at the conclusion of the third quarter. The Athletic Director in conjunction with the President shall determine the point of time during the event at which sales of alcoholic beverages conclude in intercollegiate athletic competitions other than football.

III. Regulations Governing the Consumption of Alcoholic Beverages in Carnie Smith Stadium and Al Ortolani Field Skyboxes and during Home Intercollegiate Athletic Fundraising Events

A. Carnie Smith Stadium and Al Ortolani Field Skyboxes

Consumption of alcoholic beverages is only permitted in the Skyboxes in accordance with the following policy:

1. Alcoholic beverages may be consumed in the Skyboxes three hours prior to and one hour after an organized event taking place at Carnie Smith Stadium or Al Ortolani Field. The President may approve exceptions to this time limitation, but requests for exceptions must be made in writing not later than two weeks prior to the event and will not be deemed approved unless written approval is granted prior to the event.
   If the event is not a home game, alcohol consumption in the Skyboxes is at the discretion of the event director and/or committee.  If the event is a private event, alcohol consumption is at the discretion of the Athletic Director.  A written request by a Skybox holder must be made to the event director and/or committee chairperson and/or the Athletic Director not later than two weeks prior to an event.  The event director and/or committee chairperson and/or the Athletic Director must give the Skybox holder written approval to consume alcohol at such an event before alcohol may be consumed during that event. 
2. The only time alcoholic beverages may be brought into the Skyboxes is during a designated period of time for stocking the bars in the Skybox as set forth in the Skybox holder’s Pittsburg State University Skybox Agreement.  Alcohol shall not be consumed in the Skyboxes during the designated periods for stocking the bars. If anyone attempts to bring alcohol into the Skyboxes at any time other than the designated stocking times, it will be confiscated and disposed of.
3. Alcoholic beverages from the Skyboxes shall not be consumed outside of the Skyboxes and must remain in the Skyboxes with the exception of the designated removal time.
4. Skybox holders and their guests in the Skybox shall be responsible for ensuring compliance with this policy and all applicable laws and regulations governing consumption of alcohol, including but not limited to all laws governing age of consumption of alcohol.
5. Sale of alcohol in the Skybox is prohibited.
6. Food and non-alcoholic beverages must be available in each Skybox during any times in which alcoholic beverages are available for consumption.
7. The only people permitted to consume alcohol in the Skyboxes are those people of lawful age for such consumption who possess a pass or ticket to sit in the Skybox.
8. After the last home game, each Skybox holder will be responsible for removing all alcoholic beverages.  No alcohol will be stored in the Skyboxes at any time other than during the season. As a condition of being permitted to use a Skybox, each holder must agree that Pittsburg State University will bear no responsibility for loss of any alcohol the Skybox holder chooses to store in the Skybox. Skybox holders will be required to remove all alcohol from their Skybox immediately following the final home game of the season or an event that is not a home game. 

B. Home Intercollegiate Athletic Fundraising Events

Certain fundraising events that benefit Pittsburg State University programs will be conducted in conjunction with home intercollegiate athletic events and will take place concurrent with traditional tailgating activities. 

1. Beer and cereal malt beverages may be possessed and consumed during such tailgating activities but consumption is not permitted until four hours prior to kick-off and shall cease no later than thirty minutes prior to scheduled kick-off. Beer or cereal malt beverages will not be possessed or consumed in areas outside those designated by this policy including but not limited to Carnie Smith Stadium (Skyboxes excluded).
2. Sale of alcohol is prohibited.
3. This policy does not provide authority for Pittsburg State University organizations to serve beer or cereal malt beverages as part of tailgate fundraisers.
4. All beer or cereal malt beverages possessed or consumed shall be contained in and originate from, individual 12 ounce aluminum cans. Alcohol in its original packaging and/or other containers, including cardboard boxes, plastic six-pack rings, grocery sacks (plastic, paper, reusable), tubs, or any other containers beyond a standard insulated beverage cooler will not be allowed to be brought in by pedestrians arriving at designated tailgate areas.
5. The legal drinking age of 21 years will be enforced. Individuals possessing or consuming beer or cereal malt beverages at tailgates shall possess a valid identification showing they are 21 years of age or greater and will be responsible for their conduct and that of their guests.
6. Food and non-alcoholic beverages must be available at any location where beer or cereal malt beverages are consumed.
7. Consumption of beer or cereal malt beverages in conjunction with intercollegiate athletic fundraiser tailgate activities will be permitted in the following locations:
   • Carnie Smith Stadium Events - The Brown parking lot immediately northeast and adjacent to the stadium, all parking lots immediately adjacent to McPherson Nurse Education Building and between McPherson Nurse Education Building and Weede Physical Education Building, as well as in designated areas up to 75 feet from the borders of these lots excluding the Gorilla Village.
   • Weede Physical Education Building - The parking lot immediately across Homer Street west of the facility as well as designated areas up to 25 feet from the borders of the lot.
   • O. Gene Bicknell Sports Complex - The parking lot immediately west of the varsity baseball field and the parking lot immediately west of the varsity softball field as well as designated areas up to 25 feet from the borders of these lots.
8. No one may possess, or consume beer or cereal malt beverages from any device or apparatus designed to consume the beverage at a greater than normal rate of speed.  This includes, but is not limited to, beer bongs.
9. Drinking games or any orchestrated efforts that may promote excess consumption of beer or cereal malt beverages are prohibited.
10. Failure to comply with this policy or any law governing the consumption of alcohol will result in loss of the privileges granted under this policy or subject to discipline.
11. The President may make exceptions to this policy at his or her discretion, provided the exception is in accordance with applicable state law.

IV. Regulations Governing the Use of Alcoholic Liquor in Residence Halls 

1. Subject to PSU's residence hall policies and regulations and any applicable laws, beer and cereal malt beverages may be possessed and consumed within PSU residence halls.
2. No one under the age of 21 shall be allowed to purchase, possess, or consume alcohol on the campus of Pittsburg State University.
3. Beer and cereal malt beverages in individual containers greater than 12 ounces shall not be allowed on the campus of Pittsburg State University.

V. Designated Areas Where Alcoholic Beverages May Be Consumed

Consumption of alcoholic beverages is permitted only in the following non-classroom settings:

• Jack H. Overman Student Center
• First floor lobby of Porter Hall
• First floor lobby of McCray Hall
• Reception area of McPherson Hall
• Rotunda of the Kansas Technology Center
• Lawn of Kansas Technology Center adjacent to Brooker Sundial
• Carnie Smith Stadium Skyboxes
• Crossland House
• Bicknell Family Center for the Arts
• Plaster Center
• Champions Club in the Weede Physical  Education Building
• Al Ortolani Field Skyboxes
• *Areas designated for home intercollegiate athletic fundraising events specified in Section II.B.
• *Residence Halls
• Other locations as approved by the President
