Alcohol Policy

  1. Regulations Governing the Use of Alcohol at University Events.

Under circumstances permissible by State Statutes and Regulations of the Alcoholic Beverage Control Commission, official University academic and administrative units and University affiliated organizations may serve alcohol at approved events in designated non-classroom areas on the University campus.

Alcohol may only be provided at events that are related to legitimate University functions. Such events cannot be open to the general public and only members of the sponsoring organizations, their spouses or significant others, and invited guests may be served alcohol.

The following guidelines will be observed in serving alcohol on campus (except that the Regulations Governing the Use of Alcoholic Liquor in the Carnie Smith Stadium Skyboxes and during Home Football Game Fundraising Eventsshall govern the consumption of alcohol in the Skyboxes and in designated parking areas near Carnie Smith Stadium.):

1. At all times, the serving of alcohol on the PSU campus must be in compliance with the Kansas Liquor Control Act.

2. Alcohol shall be defined as, and limited to, beer, wine, spirits, etc., containing an alcohol content of 5.0% or greater.

3. All events on the University campus in which alcohol will be consumed must be pre-approved by the President. A University unit or affiliated organization wishing to serve alcohol on campus must submit a detailed plan to the President for review prior to any public announcement, but in no case less than two weeks before the event. This detailed plan must include the number of guests that will be in attendance, the designated area in which alcohol will be served, and the control measures that will be in place to ensure this alcohol policy and the laws of the State of Kansas are not violated.

4. University Food Services shall be the exclusive caterer of the alcohol on campus. University Food Services shall provide all personnel necessary for and have full control over dispensing alcohol at approved events. University Food Services may furnish for a fee, all setups and services needed. University Food Services will adhere to the following definitions and regulations in its capacity as caterer:

  1. a. The terms used herein shall have the following meanings:

1) Events, as used in this policy, shall mean prearranged functions not advertised to the general public and limited in attendance to members of the sponsoring organizations and their guests.

2) Members - Shall mean the basic makeup of the sponsoring organization.

3) Guests - Shall mean the spouse or significant other of a sponsoring organization and invited friends.

  1. b. The length of the pre-dinner alcoholic beverage service shall be determined between the sponsoring organization and University Food Service.
  2. c. No alcohol other than that served by the staff of the University Food Service may be dispensed.

5. Members and guests of the sponsoring organization may not carry alcohol outside the area in which they are being served.

6. Nonalcoholic beverages and food must be provided at all events where alcohol is served.

II. Regulations Governing the Use of Alcoholic Liquor in the Carnie Smith Stadium Skyboxes and during Home Football Game Fundraising Events.

Alcoholic liquor will not be used, consumed, possessed or permitted near the premises or in Carnie Smith Stadium except in accordance with the following policy:

1. The only location in which alcoholic liquor is permitted in Carnie Smith Stadium is in the Skyboxes.

2. Alcoholic liquor may only be consumed in designated cups provided by Pittsburg State University and/or University Food Services and the alcoholic liquor’s original container must be immediately disposed of after its contents have been poured into a designated cup. 

3. Alcoholicliquor may be consumed in the Skyboxes three (3) hours prior to and one (1) hour after an organized event taking place at the Carnie Smith Stadium.   The President may approve exceptions to this time limitation, but requests for exceptions must be made in writing not later than two weeks prior to the event and will not be deemed approved unless written approval is granted prior to the event.

If the event is not a home football game, alcohol consumption in the Skyboxes is at the discretion of the event director and/or committee.  If the event is a private event, alcohol consumption is at the discretion of the Athletic Director.A written request by a Skybox holder must be made to the event director and/or committee chairperson and/or the Athletic Directornot later than two weeks prior to an event.  The event director and/or committee chairperson and/or the Athletic Directormust give the Skybox holder written approval to consume alcohol at such an event before alcoholic liquor may be consumed during that event. 

4. Alcoholic liquor to be consumed in the Skyboxes shall not be brought into Carnie Smith Stadium and the Skyboxes on the day of the event. The only time alcoholic liquor may be brought into Carnie Smith Stadium and the Skyboxes is during a designated period of time for stocking the bars in the suites as set forth in the Skybox holder’s Pittsburg State University Carnie Smith Stadium Skybox Agreement. Alcohol shall not be consumed in the Skyboxes during the designated periods for stocking the bars.

If anyone attempts to bring alcoholic liquor into Carnie Smith Stadium at any time other than the designated stocking times, it will be confiscated and disposed of.

5. Skybox holders and their guests in the Skybox shall be responsible for ensuring compliance with this policy and all applicable laws and regulations governing consumption of alcoholic liquors, including but not limited to all laws governing age of consumption of alcoholic liquors.

6. Sale of alcoholic liquor in the Skybox is prohibited.

7.Food and non-alcoholic beverages must be available in each Skybox during any times in which alcoholic liquor is available for consumption.

8. The only people permitted to consume alcoholic liquor in the Skyboxes are those people of lawful age for such consumption who possess a pass or ticket to sit in the Skybox.

9. After the last home football game, each Skybox holder will be responsible for removing all alcoholic liquors. No alcoholic liquor will be stored in the Skyboxes at any time other than during the football season.  As a condition of being permitted to use a Skybox, each holder must agree that Pittsburg State University will bear no responsibility for loss of any alcoholic liquor the Skybox holder chooses to store in the suite.

Skybox holders will be required to remove all alcoholic liquor from their suites immediately following the final home football game of the season or an event that is not a home football game.

10. Certain fundraising events that benefit Pittsburg State University programs will be conducted in conjunction with home football games and will take place concurrent with traditional tailgating activities. Beer or cereal malt beverages may be possessed and consumed during such tailgating activities but consumption shall cease no later than one (1) hour following the game’s conclusion.  All beer and cereal malt beverages shall be transported off-campus no later than one and a half (1 ½) hours following the game’s conclusion. Beer or cereal malt beverages will not be possessed or consumed in areas outside those designated by this policy including but not limited to Carnie Smith Stadium (Skyboxes excluded). Sale of beer or cereal malt beverages will be prohibited. This policy does not provide authority for Pittsburg State University organizations to serve beer or cereal malt as part of tailgate fund raisers. All beer or cereal malt beverages possessed or consumed shall be contained in, or originated from, individual twelve (12) ounce aluminum cans.The legal drinking age of 21 years will be enforced.  Individuals possessing or consuming beer or cereal malt beverages at tailgates shall posses a valid identification showing they are 21 years of age or greater and will be responsible for their conduct and that of their guests. Food and non-alcoholic beverages must be available at any location where beer or cereal malt beverages are consumed.

Consumption of beer or cereal malt in conjunction with fundraiser tailgate activities will be permitted in the Brown parking lots immediately adjacent to the Carnie Smith Stadium, all parking lots immediately adjacent to McPherson Nurse Education Building and between McPherson Nurse Education Building and Weede Physical Education Building, as well as in designated areas up to 75 feet from these lots excluding the Gorilla Village.

11. Failure to comply with this policy or any law governing the consumption of alcoholic liquor (including beer and cereal malt beverages) will result in loss of the privileges granted under this policy.

III. Cereal Malt Beverages (3.2% Beer or Wine Coolers).

Board of Regents’ policy permits the service and consumption of cereal malt beverages (3.2% beer or wine coolers) under authorized and appropriately controlled conditions and regulations to be determined by the chief executive officer of each university.  The President of Pittsburg State University has adopted the following policies on the sale and consumption of cereal malt beverages at Pittsburg State University:

1. No one under the age of twenty-one (21) shall be allowed to purchase, possess, or consume cereal malt beverages on the campus of Pittsburg State University.

2. Cereal malt beverages in individual containers greater than twelve (12) ounces shall not be allowed on the campus of Pittsburg State University.

3. Subject to PSU’s residence hall / hall living policies and regulations and any applicable provisions under this Article III, cereal malt beverages may be possessed and consumed within PSU residence halls.

4. The sale of cereal malt beverages by the food service contractor recognized by the University will be allowed at events (subject to paragraph seven (7)hereunder) in the Jack H. Overman Student Center of Pittsburg State University for a period of time no longer than four (4) consecutive hours between the times of 12:00 p.m. and 10:30 p.m. Central Standard Time.   

5. The a fore described food service contractor shall have the exclusive rights to the sale of all cereal malt beverages at events (subject to paragraph seven (7)hereunder) in the Jack H. Overman Student Center of Pittsburg State University.  The food service contractor shall be responsible for the event’s compliance with federal, state, and local laws and ordinances related to the sale and consumption of cereal malt beverages and any applicable provisions under this Article III, shall provide all personnel necessary for, and full control over, dispensing cereal malt beverages at events, and may furnish for a fee, all setups and services needed. 

6. Subject to any applicable provisions under this Article III, only cereal malt beverages purchased from the a fore described food service contractor may be consumed at events (subject to paragraph seven (7)hereunder) in the Jack H. Overman Student Center of Pittsburg State University. 

7. Pittsburg State University has adopted the following policies regarding events at the Jack H. Overman Student Center where cereal malt beverages will be sold or consumed:

    • The events may not be open to the public.
    • The person, persons, organization, or organizations hosting the event shall have an invitation list of those invited to attend the event.  Only invitees shall be permitted to attend the event.
    • Non-alcoholic beverages (not including water)shall be available to invitees during the entire event.
    • Food shall be served during the event.
    • The event must commence no later than 12:00 a.m. on the calendar day following the calendar day the event began (midnight). 
    • The event must be pre-approved by the President.
    • Approximately seventy-five percent (75%) of the guests in attendance shall be twenty-one (21) years of age or older or accompanied by their legal guardian. 
    • The person, persons, organization or organizations hosting the event must submit a detailed plan of the event to the President for review and approval at least 30 days before the event.  This detailed plan must include the list of those invited, an estimated number of people that will be attending the event, the events duration, and show how the event will comply with the policies under this Article III.

8. Cereal malt beverage possession and consumption is permitted during home football game fundraising events subject to Article II of this Pittsburg State University Alcohol Policy.

IV. Designated Areas Where Alcoholic Beverages May Be Consumed.

Consumption of alcoholic beverages, number seven (7) below being limited to the consumption of beer only, is permitted only in the following non-classroom settings:

  1. Jack Overman Student Center
  2. First floor lobby of Porter Hall
  3. First floor lobby of McCray Hall
  4. Reception area of McPherson Hall
  5. Rotunda of the Kansas Technology Center
  6. Lawn of Kansas Technology Center adjacent to Brooker Sundial
  7. Carnie Smith Stadium Skyboxes
  8. Brown parking lots immediately adjacent to the Carnie Smith Stadium, all parking lots immediately adjacent to McPherson Nurse Education Building and between McPherson Nurse Education Building and Weede Physical Education Building, as well as in designated areas up to 75 feet from these lots excluding the Gorilla Village.
  9. Other locations as approved by the President.
